## Before the contractor starts

- Confirm the contractor's licence covers the work and the number of workers.
- Confirm the principal employer's own registration, where the law requires one.
- Put the compliance duties in the contract: wages on time, PF and ESI paid, records shared.

## Every month

- Ask for the wage register, the PF and ESI challans and the attendance record.
- Be present when wages are paid where the rules require it, or sample-check the payment.

## When it goes wrong

If the contractor fails to pay wages or contributions, the principal employer must make good and may recover it from the contractor. Holding back the contractor's payment until the evidence arrives is the practical control.

In this portal a contractor is a vendor: record the contract, assign the compliance to the vendor and review what they submit.

> This is working guidance for your team, not legal advice. Confirm the details against the current text of the law and your State's rules before you rely on them.

## Frequently asked questions

### Is a housekeeping contractor covered?

Usually yes, if they employ the threshold number of workers. The size test is on the contractor's headcount, not yours.

### Can we stop paying the contractor if they miss a filing?

Your contract should say so. Without a clause you may end up in a dispute, so write the right into the agreement up front.
